The deceased must have communicated details of the property subject to the trust: Re Colin Cooper  Ch 580. The testator left £5,000 to two people and communicated the terms of the trust to them. By a later codicil, he increased the sum to £10,000. The addition was not communicated to the intended trustees. Held: the first £5,000 was subject to the trusts; the other £5,000 was held on a resulting trust. This was a half-secret trust case, the fact (but not the terms) of a trust appearing on the face of the will, but the principle applies equally to fully secret trusts.
