The test for certainty of objects of powers of appointment was laid down by the House of Lords in Re Gulbenkian’s Settlement Trusts  AC 508. Lord Upjohn said: The power is valid if it can be said with certainty whether any given individual is or is not a member of the class and does not fail because it is impossible to ascertain every member of the class.
