A number of important cases have arisen as a result of UK military involvement in Iraq since 2003. In R (on application of Al-Skeini and Others) v Secretary of State for Defence [2007] UKHL 26, the applicants were relatives of six Iraqi civilians who, it was claimed, had been killed by UK armed forces in Basra during 2003. The House of Lords decided at this point that the ECHR would extend to human rights abuses that occur outside the territorial jurisdiction of the United Kingdom in very limited situations. Their Lordships decided that the claims relating to five of the Iraqi civilians, who were all killed in the course of general security operations, could not succeed because the UK did not exercise sufficient control over Iraq at the relevant time.
