7.- ¿Cómo se disuelve el matrimonio en Roma?

  1. Muerte de uno de los esposos.
    1. El marido podía volver a casarse inmediatamente.
    2. La mujer debía guardar diez meses (para evitar la confusión de parto, o sea para no hacer incierta la filiación paterna del hijo que naciere). La violación de esta regla, por parte de la mujer, provocaba la tacha de infamia para ella, para el segundo marido y para los ascendientes de uno u otro que, teniendo autoridad sobre ellos, hubiesen consentido el matrimonio.
  2. Pérdida del connubium. Resultante de la reducción a esclavitud. Si el marido caía prisionero del enemigo, el matrimonio se disolvía, aunque el postliminium no borraba el hecho de la separación material de los esposos. Pero si ambos esposos habían caído prisioneros y no había cesado la cohabitación entre ellos, no habiendo separación de hecho, la esclavitud se consideraba borrada jure postlimimii y el matrimonio subsistía.
  3. Divorcio repudio.
    1. Matrimonio cum manu. Estando colocada la mujer en situación de hija, sólo el marido podía disolver estas uniones, mediante la facultad de repudio.
    2. Matrimonios sine manu. En estos casos, ambos esposos tenían iguales derechos en cuanto a divorcio. Pero como en los primeros siglos los matrimonios sine manu fuero muy raros, casi no hubo divorcios. Hacia fin de la República y sobre todo bajo el Imperio, las costumbres se relajaron y la manus se hizo más rara, proliferando entonces los divorcios, que podían efectuarse de dos maneras:
  4. Bona gratia.Por mutua voluntad de los esposos, sin requerirse formalidad alguna, pues el desacuerdo disuelve lo que el acuerdo había unido.
  5. Por repudiación.Por voluntad de uno de los esposos (tanto el hombre como la mi jer). La lex Julia de aduíterii: exigió que el esposo que quisiera divorciarse notificase al otro su voluntad en presencia de siete testigos, ora mente o por un acta especial. Los emperadores cristianos no suprimieron el divorcio, pero trata: ron de dificultarlo, obligando a precisar las causas legítimas d repudiación.

Fueron reprimidas las repudiaciones realizadas sin justa causa.

You will not be simply intuitive, but rather you will analyze the information you glean in this empathic fashion, gaining insights. You will continually cycle between empathy and analysis, always updating what you observe and increasing your ability to see the world through their eyes. You will notice a physical sensation of connection between you and the other that will emerge from this practice.

You will need a degree of humility in this process. You can never know exactly what people are thinking and can easily make mistakes, and so you must not rush to judgments but keep yourself open to learning more. People are more complex than you imagine. Your goal is to simply see their point of view better. As you go through this process, it becomes like a muscle that gets stronger the more you exercise it.

Cultivating such empathy will have innumerable benefits. We are all self-absorbed, locked in our own worlds. It is a therapeutic and liberating experience to be drawn outside ourselves and into the world of another. It is what attracts us to film and any form of fiction, entering the minds and perspectives of people so different from ourselves. Through this practice your whole way of thinking will shift. You are training yourself to let go of preconceptions, to be alive in the moment, and to continually adapt your ideas about people. You will find such fluidity affecting how you attack problems in general—you will find yourself entertaining other possibilities, taking alternative perspectives. This is the essence of creative thinking.
