Profit Maximization In free markets—and even in regulated market economies—profit maximization tends to promote economic welfare and a higher standard of living, and creates wealth for investors. Profit motivates businesses to use resources efficiently and to concentrate on activities in which they have a competitive advantage. Most economists believe that profit maximization promotes allocational efficiency—that resources flow into their highest valued uses. Overall, the functions of profit are as follows: Rewards entrepreneurs for risk taking when pursuing business ventures to satisfy consumer demand. Allocates resources to their most-efficient use; input factors flow from sectors with economic losses to sectors with economic profit, where profit reflects goods most desired by society. III. Componentes del expediente electrónico. III.1 Los componentes de un expediente electrónico son: a) Documentos electrónicos, que cumplirán las características de estructura y formato establecidas en la Norma Técnica de Interoperabilidad de Documento electrónico. Los documentos electrónicos podrán incluirse en un expediente electrónico bien directamente como elementos independientes, bien dentro de una carpeta, entendida ésta como una agrupación de documentos electrónicos creada por un motivo funcional, o bien como parte de otro expediente, anidado en el primero. b) Índice electrónico, que según lo establecido en el artículo 32.2 de la Ley 11/2007, de 22 de junio, de acceso electrónico de los ciudadanos a los Servicios Públicos, garantizará la integridad del expediente electrónico y permitirá su recuperación siempre que sea preciso. El índice electrónico recogerá el conjunto de documentos electrónicos asociados al expediente en un momento dado y, si es el caso, su disposición en carpetas o expedientes. c) Firma del índice electrónico por la Administración, órgano o entidad actuante de acuerdo con la normativa aplicable. d) Metadatos del expediente electrónico.

Documentos electrónicos: objetos digitales administrativos de cada una de las actuaciones administrativas que integran el expediente, y que contienen la información (contenido y firma) y los datos asociados a ésta (metadatos) que, como tales, han de cumplir lo establecido en la NTI de Documento Electrónico. La NTI cita el hecho de que los documentos electrónicos pueden incluirse en un expediente electrónico de diferentes formas: a. Directamente como elementos independientes. b. Dentro de una carpeta, entendida ésta como una agrupación de documentos electrónicos creada por un motivo funcional, para la que no existe normativa específica de ámbito general desarrollada. c. Como parte de un sub-expediente electrónico, entendido éste como un expediente electrónico anidado dentro de otro, y que, como tal, sigue la estructura y consideraciones definidas en la NTI de Expediente Electrónico. La inclusión de un sub-expediente puede deberse a la existencia de expedientes vinculados al expediente que lo contiene o, tal y como se desarrolla más adelante, a la generación de un expediente que contenga parte o la totalidad del expediente electrónico original en un momento determinado del tiempo con el fin de satisfacer posibles solicitudes de remisión o puesta a disposición. El contenido y características de un expediente vinculado evolucionan conforme al procedimiento con el que se corresponde dicho sub-expediente, independientemente de su vinculación a otro, reflejándose dichos cambios en el expediente que lo contiene.

Índice electrónico: definido en el epígrafe III.1.b y que constituye un objeto digital que contiene la identificación sustancial de los documentos electrónicos que componen el expediente debidamente ordenada para reflejar la disposición de los documentos, así como otros datos con el fin de preservar la integridad y permitir la recuperación del mismo, en los términos del artículo 70.3 de la citada Ley 39/2015, de 1 de octubre de 2015. El contenido del índice del expediente puede variar según las necesidades de cada organización, la cual puede diseñar diferentes patrones que se ajusten a las actividades y diferentes tipos de procedimientos que desarrolla. También cabe contemplar la utilización de este patrón del índice para definir qué documentos deben integrar un determinado tipo de expediente. La NTI no establece consideraciones sobre patrones de índice que, en cualquier caso, serían definidos con carácter previo por cada organización en particular, y asociados a las funciones de normalización de procedimientos a las que hace referencia el R.D. 4/2010 ENI en su artículo 9. La NTI no establece ninguna consideración relativa al tratamiento del índice electrónico como documento electrónico o como otro tipo de objeto digital a nivel interno de cada organización, sino que se limita a reflejar sus características funcionales y sólo establece una implementación concreta de cara al intercambio del expediente. Nótese que en la estructura XML para el intercambio de expedientes, el índice no constituye un documento electrónico en tanto que no tiene metadatos mínimos obligatorios asociados. Por tanto, es responsabilidad de cada organización el diseño e implementación del índice de sus expedientes bajo la fórmula que mejor se ajuste a sus necesidades y normativa específica aplicable, con la única restricción de que permita la traslación de la información a la estructura XML indicada en la NTI en caso de intercambio.

Firma del índice electrónico: firma electrónica que garantiza la autenticidad e integridad del contenido del índice, y por extensión, de los documentos que conforman el expediente electrónico así como de su estructura. Tal y como cita el epígrafe III.1.c, la firma del índice del expediente electrónico es realizada por la organización responsable de dicho expediente, mediante uno de los sistemas de firma previstos en la normativa aplicable. En este caso, los sistemas de firma electrónica por parte de las organizaciones que pueden ser utilizados aparecen en los artículos 42 y 43 de la Ley 40/2015, de 1 de octubre, y son: - Firma electrónica basada en certificados, cuya aplicación se realiza según lo establecido en la Política de firma que corresponda. Dicha Política se desarrolla conforme a la normativa específica aplicable y, en cualquier caso, según las condiciones técnicas establecidas en la NTI de Política de firma y certificados de la Administración, en la que se especifican formatos de firma admitidos, reglas de creación y verificación, uso de sellos de tiempo, firmas longevas, algoritmos, etc. - Sistemas de Código Seguro de Verificación (CSV), en cuyo caso es de aplicación lo dispuesto en los artículos 20 y 21 del Real Decreto 1671/2009, de 6 de noviembre, por el que se desarrolla parcialmente la Ley 11/2007, de 22 de junio, de acceso electrónico de los ciudadanos a los servicios públicos (en adelante R.D. 1671/2009, de 6 de noviembre).

La N TI no hace ningún tipo de previsión sobre la implementación de los metadatos del expediente en general, ya sean mínimos obligatorios o complementarios, ni por tanto de su firma. Nótese no obstante que, en caso de intercambio, los metadatos mínimos obligatorios serán integrados bajo la estructura XML establecida, sobre la que, si una organización lo considera conveniente, podría aplicarse una firma electrónica que incluyese dichos metadatos. Al igual que para cualquier documento electrónico, la forma de implementación de los metadatos de un expediente electrónico para su tratamiento y gestión a nivel interno es libre y, como tal, será diseñada por cada organización en base a sus necesidades, criterios y normativa específica. Sólo en el caso en que el expediente electrónico intervenga en un proceso de intercambio, la implementación de sus metadatos mínimos obligatorios, junto al resto de sus componentes, se realizará según la estructura y condiciones establecidas en el punto 4.5.1 de esta guía.
